At Dila Tarım, we place the utmost importance on the security of personal data. We ensure that the collection, storage, and sharing of your personal data comply with legal regulations and take the highest level of security measures to protect your privacy. Aware of this responsibility, we process your personal data in accordance with the Personal Data Protection Law No. 6698 (KVKK) as a data controller, as explained below.

1) Identity of the Data Controller and Representative

In accordance with Article 10 of the Personal Data Protection Law No. 6698 (KVKK), the scope in which your personal data may be processed by Dila Tarım as the data controller is detailed below.

2) Purpose of Processing Personal Data

Your collected personal data may be processed by Dila Tarım in accordance with the fundamental principles stipulated by law and for the following purposes:

  • Ensuring that Dila Tarım’s commercial activities are carried out in compliance with legal regulations and company policies;
  • Managing and implementing Dila Tarım’s human resources policies;
  • Determining, planning, and executing short, medium, and long-term commercial policies;
  • Ensuring the commercial, technical, and legal security of individuals in business relationships with Dila Tarım and maintaining communication with such individuals;
  • Protecting the commercial reputation and trust established by Dila Tarım;
  • Complying with obligations imposed by legal regulations, including information retention, reporting, and notification obligations required by official authorities;
  • Managing financial operations, communications, market research, social responsibility activities, procurement operations (requests, evaluations, orders, budgeting), internal system and application management, and legal processes in line with the company’s commercial and business strategies;
  • Reviewing, evaluating, and responding to requests from official authorities or related persons;
  • Ensuring the security and supervision of physical locations belonging to the company through surveillance and other monitoring systems;
  • Fulfilling evidentiary obligations in case of potential legal disputes in the future.

Your personal data may also be classified for automated decision-making processes, which are necessary for reports and documents to be submitted to relevant authorities.

Processing personal data is legally and contractually mandatory. If personal data is not provided, it may become impossible to conduct business activities, fulfill legal obligations, implement human resources operations, and ensure legal, technical, and commercial security.

3) Transfer of Personal Data and International Data Transfers

Personal data may be transferred within the framework of KVKK Articles 8 and 9 to the following parties:

  • Dila Tarım’s business partners and affiliates;
  • Individuals and institutions permitted by the Turkish Commercial Code, Turkish Code of Obligations, Labor Law, and other relevant legal regulations;
  • Legally authorized public institutions and administrative or judicial authorities;
  • Individuals and companies with whom we collaborate or receive services.

Before any transfer, compliance with KVKK and data security measures will be ensured.

According to Article 9 of KVKK, international data transfers may occur if:

  • The data subject provides explicit consent;
  • The data is transferred to a country with adequate protection (as determined by the Personal Data Protection Board);
  • If adequate protection is not available, the data controller guarantees adequate protection in writing and obtains approval from the Board.

The Personal Data Protection Board will announce the list of countries deemed secure.

4) Collection Methods and Legal Basis for Processing Personal Data

Your personal data is collected by our company through various channels (verbal, written, or electronic) for compliance with legal regulations and company policies, fulfillment of contracts, explicit legal requirements, and the company’s legitimate interests.

In accordance with KVKK’s fundamental principles, your personal data may be processed and transferred as outlined in this Privacy Policy, following the conditions and purposes set out in Articles 5 and 6 of KVKK.

5) Retention Period for Personal Data

Personal data is stored for the period stipulated by relevant regulations or for as long as necessary to achieve the processing purpose. The maximum retention period is determined based on:

  • Industry standards and common practices regarding data retention;
  • The duration of the legal relationship established with the data subject;
  • The legitimate interest of the data controller in processing the data in compliance with laws and good faith principles;
  • The risks, costs, and legal responsibilities associated with retaining the data;
  • The necessity of keeping the data up-to-date and accurate;
  • Legal obligations that require the data to be retained;
  • The statute of limitations for any claims that may arise concerning the data.

6) Rights of Data Subjects Under Article 11 of KVKK

Data subjects may submit their requests regarding their rights via the methods outlined in Dila Tarım’s Personal Data Protection and Processing Policy, available on www.dilatarim.com. Requests will be processed as quickly as possible and no later than 30 days. If the request involves an additional cost, Dila Tarım may charge the fee determined by the Personal Data Protection Board.

Within this scope, data subjects have the right to:

  • Learn whether their personal data is being processed;
  • Request information if their personal data has been processed;
  • Learn the purpose of processing personal data and whether it is used in accordance with its purpose;
  • Know the third parties to whom personal data is transferred domestically or internationally;
  • Request correction if personal data is incomplete or inaccurate;
  • Request the deletion or destruction of personal data under the conditions stipulated in KVKK;
  • Request notification of any corrections or deletions to third parties to whom personal data has been transferred;
  • Object to the processing of personal data if it results in an unfavorable outcome for the data subject;
  • Demand compensation for damages if personal data is processed unlawfully.
